CANTON • The stately
live oak trees around the
Van Zandt County Cour-
thouse in Canton may be in
danger, and that has
caused a political flap.
It is possible that the
trees may die because some
of their roots have been cut
during the rebuilding of
had “no choice” but to
meet the requirements,
Hilliard said.
"Nobody hated worse
than I did having to cut
those trees,” Hilliard said.
He pointed out, however,
that the tree roots were
pushing the sidewalk sec-
tions up “four or five in-
the sidewalks surrounding ches,” and added that it

the courthouse.
The trees are nearly as
old as the courthouse, built
in 1937, and the massive
roots were pushing the old
concrete walk up several
inches in some places. The
topmost roots were cut to
level out the sidewalk.
After a severe freeze last
winter and a prolonged
drought this summer, the
trees may be weakened
enough that the root
damage may kill them.
Some admirers of the trees
have said that they would
hold County Judge Sam
Hilliard responsible if any
of the trees die. Other
solutions could have been
found, the persons said,
such as pouring another
layer of concrete on the
existing walk.
Hilliard said Monday
that he did not want to cut
the roots, either, but
federal election laws con-
cerning access to buildings
for handicapped in-
dividuals forced the county
to level the sidewalks, and
that meant cutting the
roots.
Officials in Washington,
D. C., sent a list of com
plaints about the cour-
thouse and the barriers it
presented to handicapped
individuals, and the county

was dangerous to walk
down the sidewalk in
places. Not fixing the
sidewalk could open the
county to lawsuits if
anybody was to trip and
fall, he said.
“We also got a com-
plaint from a wheelchair-
bound person locally," he
said.
Federal law requires the
county to provide barrier-
free access to the cour-
thouse by 1986, because
elections are held in the
courthouse. The most ex-
pensive item on the
required improvements list
was a barrier-free entran-
ceway, which was com-
pleted last spring at a cost
of $30,000.
Other items included
changing the level of the

elevator (or providing an

sidewalks, Hilliard repor-
ted.
“I do hope that it doesn't
kill the trees," he said, “but
we found no other way to
fix the walk than to do
what we did." The county
has already spent ap-
proximately $888 on the
project, not counting the
cost of cement and the steel
reinforcement wires,
Hilliard said.
The county has met the
other federal requiremen
ts, Hilliard said. “From the
federal standpoint, we’ve
answered two long
questionnaires on the han-
dicapped requirements,”
he added.
All of the walk around
the courthouse has now
been replaced, except for a
portion on the northwest
corner, and a topco«ting of
cement may be able to take
care of a minor problem
there, Hilliard said.
The trees needed to be
pruned, to help ease the
shock of cutting some
roots, Hilliard noted, and

on cars now. "We paid for
damage on two cars last
winter caused by ice (on
limbs),” Hilliard said.
A professional tree
surgeon should be retained
to prune the trees, the
court agreed, as Precinct 4
Commissioner Carbon
Smith noted, “I think we
ought to wait until we get
some moisture in the
ground first.”
After the meeting broke
up, Hilliard recalled that
when the new barrier-free
entrariceway into the cour-
thouse basement was under
construction, the contrac-
tor “told us then that we
ought to cut the trees. The
(courthouse) lawn was full
of roots, and they were
pushing against the foun-
dation. They’ll eventually
crack the foundation, he
said."
Hilliard added, “All of
us wants to see them sur-
vive, but it was one of those
things where we didn’t
have any choice."
