Sportsman harassment
covered by law
AUSTIN - As the anti-
hunter movement grows,
more and more hunters and
fishermen may come up
against a member of a group
that wants to disrupt the
sportsman’s right to hunt or
fish.
Sportsmen should know
that they have an avenue to
take if someone impedes their
lawful right to hunt, trap or
fish - the Sportsman’s Rights
Act, enacted by the 69th
Texas Legislature in 1985.
The Sportsman’s Rights
Act (Section 62.0125 of the
Texas Parks and Wildlife
Code) reads, in part:
(c) No person may inten-
tionally interfere with another
person lawfully engaged in
the process of hunting or cat-
ching wildlife.
(d) No person may inten-
tionally harass, drive or
disturb any wildlife for the
purpose of disrupting a per-
son lawfully engaged in the
process of hunting or cat-
ching wildlife.
(e) No person may enter or
remain on public land or
enter or remain on private
land without the landowner’s
or his agent’s consent if the
person intends to disrupt
another person lawfully
engaged in the process of
hunting or catching wildlife.

Code misdemeanor,
punishable by a fine of $200
to $1,000 and up to 180 days
in jail or both, said Jim
Robertson with TPWD’s law
enforcement division in
Austin.
“Sportsmen who have
been harassed need to contact
their local game warden or
prosecutors,’’ he said. “Any
game warden or other state
peace officer can take the in-
formation on an allegation.
The peace officer then will
contact the district or county
attorney seeking
prosecution.’’
Sportsmen should be warn-
ed, though, not to take the
law into their own hands.
Sportsmen are still subject to
prosecution for assault, ter-
roristic threat, etc., even if
provoked by hunter harass-
ment. Their remedy is the
court system.
“Very little of this takes
place in Texas, although it’s a
growing concern and the
public needs to be aware that
if they are harassed while
hunting or fishing these peo-
ple stand liable for prosecu-
tion for their criminal act,”
Robertson said. “The Parks
and Wildlife Department will
actively seek prosecution in
these cases.”
If you have been harassed
contact your local game
warden or contact the depart-
ment’s Austin headquarters at
1-800-792-1112.
