against the US. Corps of

. transfer of the case filed in a
federal Galveston .County
courtroom to a'Houston feder-
al courtroom. .
- “Based oh the fact that most
of the plaindffs.in the lawsuit

this ds a reasonable decision,"
said Jim Edmonds, Port of
Houston Authority chairman.
. While the lawsuit is related

The lawsuit argues that die

Jim Blackburn, who filed
the lawsuit onjfohaff of sever-
al organizations, said he
cOuldn’t be happier with die
decision to transfer the case.
“Judge Kent (the original
judge hi Galveston County)
knows about the Corps of
Engineers, but he felt too
much, of the case was in
Harris County," Blackburn
said. “If we win if would post-
• pone the project and also if the
Ujqth gets told I don't think
people will want Bayport”
Blackburn also said he has
heard the Pbrt may become a
participant in the lawsuit
“They're not named, but
they could become a partici-
pant, and I’m told that it’s like-
ly they could do that,”
Blackburn said.
The Corps will consider
public comments on the Final
Environmental . Impact
Statement prior to preparing
its Record of Decision, which
is expected in late August. The
RPD will either authorize the

Bids considered
for Garth Road
signal project
By WHIT SNYDER
The Baytown Sun
BAYTOWN — The Municipal
Development District meeting scheduled for
Thursday was canceled because of the accep-
tance of bids for the long-anticipated Garth
Road signalization project. '■ -
Houston-based Statewide Traffic submitted
a base bid of $256,542 to provide construction
for the project, plus a second bid to provide,
LED signal heads for $71,270. Because the
combined bid is less than the anticipated cost,
ah MDD board vote was unnecessary to
accept the pair for consideration.
“When you combine those two with the
engineering costs, they come in under the
$450,000, which is the funding provided by
MDD for the project,” said City Clerk Gary
Smith. “That means we need no more action
from MDD." '" . .
Last month, city council unanimously
approved the city’s rejection of all bids for the
Garth Road signalization project.
The city received three bids for the $1.3
million project in May, but rejected them all
because two did not meet bid specifications
and the third would cost at least $150,000
more than expected. .". . 1.
. Bids were re-opened July 1. Council will
take actipn for approval July 10. ‘ ; •'
