at Dallas during the Taft celebration precinct in a first-class

quoted as saying that "the nfe of the
militia depends on Manley's acquit
tai.” We think the reverse. If Man-
ley’s trial'results in acquittal. it will
mean a serious blow to ttie militia
in Texas.-A militiaman has no great-
er moral right to kill an inoffen-
sive citizen in time of peace than
any Other citizen. And. if-the courts
decide he has the legal right* so to
do, public sentiment will demand
———the abandonment of (he militia, or
the limiting of their use to times of
war or riot and prohibiting their
use as police. No peace officer has
even a legal right to kill a prisoner
unless his life in in danger. Mah-
'ley was doing the duty of a poilce-
man and there is. we believe, not
even a contention on his part that
