Pertaining to the public health of
the incorporated town of Alpine.
Be it ordained by the town council of
the incorporated town of Alpine, Brew-
ster county, State of Texas, that,
Sec. 1. Any persoe who shall, with-
in this city, knowingly sell the flesh of
any animal, dying otherwise than by
slaughter or slaughtered when dis-
eased, -or shall sell any kind of cor-
rupted, diseased, or unwholesome sub-
stance, whether for food or drink,
without making fully k nown to buyer,
shall be deemed guilty of a misdemea-
nor, and on conviction, shall be fined
not less than twenty nor more than
one hundred dollars.

which cattle or other animals are kept,
in this city, in such a manner as to be-
come offensive, or any annoyance to
any person whatever, shall be deemed
guilty of a misdemeanor, and on con-
viction shall be fined not less than five
'nor more than one hundred dollars.
Sec 5. Any person who owns, keeps
or uses any hotel, restaurant, cook
shop, dairy or other establishment in
this city, in such a manner as to be
unwholesome, nauseous or offensive,

ject to an occupation tax by the laws
of the State of Texas, equal to one-
fourth of the occupation tax levied by

wholesome substance, or liquid shall
flow, or be thrown or discharged there-
from into or upon any street, alley gut-
ter, yard, lot or other adjacent public,
ground, shall be deemed guilty of a
misdemeanor, and upon conviction
shall be fined not less than five nor
more than one hundred dollars.
Sec. 6. Any person who shall per-
mit any priyv, vault, sink. cellar, pool,
private drain or sewer in or upon any
premises owned or controlled by him
in this city, to become nauseous, foul,
offensive or injurious to the health of
those who reside in the vicinity shall
be deemed guilty of a misdemeanor,
and on conviction shall be fined not
less than five nor more than one hun-
dred dollars.
Sec. 7. Any person who shall de-
posit thereon, or fill up wilh offensive
or unwholesome matter any lot or
ground in this city, so that same may
become a nuisance,- or injurious to
those who reside in the vicinity there-
of, shall be deemed guilty of a misde-
meanor, and on conviction shall be
fined not less than five nor more than
one hundred dollars
Sec. 8. Any person who shall know-
ingly allow any dead carcass or body of
any horse, mule, cow, hog dog, cat or
other animal belonging to him, or in his
possession, which may come to its death
from any cause, to lie, or shall drag
and deposit same in or upon any street,
alley, lane or other public or private
grounds within this city, shall be
deemed guilty of a misdemeanor, and
on conviction shall be fined not less
than five nor more than one hundred
dollars.
Sec. 9. Each separate day on which
any violation of any provision of the
foregoing article of this ordinance may
continue, shall be considered a sepa-
rate and distinct offense and subject
the offender to a similar fine and pun-
ishment as that prescribed for the first
violation thereof.
Sec. 10. It shall be the duty of all
persons to remove beyond the city lim-
its the carcasses of all animals belong-
ing to him, which may die on their
premises, or while in their charge, and
any person who shall suffer or know-
ingly allow the carcass of any horse,
mule, ox, cow, hog, dog, cat or other
animal belonging to him, or in his pos-
session, which may come to its death
by any cause, to lie unburied, or shall
drag or deposit same in or upon any
street, ally, lane or other public or
private grounds within this city, with-
out burying the same he shall be
deemed guilty of a misdemeanor, and
on conviction shall be ffned not less
than five nor more than one hundred
dollars.
Sec. 11. Any drayman, scavenger,
carrier or any other person, who shall
drag, haul, or carry in any way any
dead animals or carcasses of any kind
from the place where such animals or
carcasses are found dead, and shall
leave or deposit the same within the
corporate limits of this city shall be
fined not less than five nor more than
one hundred dollars.
Sec. 12. Any person who shall sell

Sec 14. Any person or persons of-
fering any meats or milk for sale in
this city, who shall refuse when re-
quested, to allow the City Health Phy-
sician to examine the same, or who
shall refuse to answer any and all le-
gitimate questions that may be pro
pounded to him by the City Health
Physician concerning such meats or
milk, and the examination thereof,
shall be deemed guilty of a misde-
meanor, and upon conviction thereof,
shall be fined not less than five nor
more than one hundred dollars.

AN ORDINANCE.
Authorizing the Impounding of Stock.
Be it.ordained by the town council of
the incorporated town of Alpine, Brew-
ster county, State of Texas, that
Sec. 1. All hogs, goats, cows,
calves oxen, or cattle, ghorses, mules,
jack-asses, jennets and sheep running
at large within the corporate limits of
the city of Alpine are hereby declared
a public nuisance and they shall be
removed as hereinafter provided.
The City Marshal is the public pound
keeper of the city of Alpine. It shall
be his duty to keep up all hogs, calves,
cows, goats, oxen or cattle, horses,
mules, jack-asses, jennets and sheep
running at large within the corporate
limits of the city of Alpine, and im-
pound the same in the public pound
until they are disposed of as hereinaf-
ter provided. The City Marshal shall
sell the animal so impounded at public
auction, for caah, to the highest bid-
der, at such time and place as he shall
designate after giving five full days no-
tice by posting written notices 10 at
least three public places in the city of
Alpine, one of which shall be on the
bulletin board in the court house, and
one at the postoffice, describing the
animal to be sold. After deducting
the expenses incurred in catching, im-
pounding, keeping and selling such an
imal, the surplus, if any, shall be paid
to the owner on proof of ownership.
If no owner apply for said surplus
within thirty days it shall be paid into
the city treasury.
Sec . 2. The owner or owners of any
animals sold under the provision of
this ordinance may redeem the same
at any time within ten days from the
date of sale by paying the purchaser
the amount of purchase money and all
reasonable expenses the purchaser
may have incurred in keeping the
same.
Sec. 3. All owners of hogs, goats,
cows, calves, oxen or cattle, horses,
mules, jack-asses, jennets and sheep,
may redeem the same at any time* be-
fore the sale by paying the cost of tak-
ing up, impounding and keeping said
animals, and filing with the city mar-
shal an affidavit of ownershid and such
other proof as he may require.
Sec. 4. The City Marshal shall
keep a correct description of all ani-
mals impounded or sold under the pro-
visions of this ordinance; date of im-
pounding, date of sale, price for which
sold, and the name of the purchaser,
in a book kept by him for this purpose,
which book shall be subject to exam-
ination at all tiNes by any persen.
Sec. 5. All persons are prohibited
from tying or staking out any such an-
imal on or across any street or alley in
this city, or so near thereto that such
animal can get on or across such alley,
sidewalk, street, corner or crossing,
and the city marshal is required to im-
pound any such animal, the same as if
said animal or animals were running at
large, and he shall be entitled to col-
lect such fees for enforcing this sec-
tion as are herein allowed for impound-
ing of other animals under this ordi-
nance.
Sec 6. For each animal impounded
the city marshal shall collect a fee of
one dollar where such animal is redeem-
ed before sale. For each animal sold
the city marshal shall collect a fee of
two dollars which shall be taken out of
the proceeds of the sale of such ani-
mal, after the cost of keeping such an-
imal has been paid.
Sec. 7. One-half of the fees for im-
pounding stock shall be paid into the
city treasury, the other one-half to be
paid to the city marshal as his fee.
