2THE ISSUE
In response to a request from the University Interscholastic League,
Attorney General Mark White has issued an opinion concerning
Senate Bill 1218 passed by the 66th Legislature The new law states
in part that no durational residence requirement may be used to
prohibit a child placed in foster care by an agency of the state from
participating in any activity sponsored by the school district. The at-
torney general advised the UIL in Opinion MW-43 that three of its
rules which impose a durational residence requirement on students
participating in many extracurricular activities no longer apply to stu-
dents placed in foster homes. This opinion appears in the Attorney
General's section
The Texas Department of Health has adopted new rules to provide
minimum licensing standards for personal care homes. After circulat-
ing the rules to interested organizations and holding six public hear-
ings, the department made several changes in the rules from their
proposed form. The department incorporated comments and sugges-
tions concerning self-administration of medication by residents; at-
tendant/resident ratio; services offered to meet resident needs for
emotional support; facility exemptions; and resident medical ex-
Saminations. The new standards will be effective September 28, 1979.
The State Securities Board proposes amendment of its rule which
outlines recordkeeping requirements for securities dealers licensed
in Texas. Under the proposed rule. compliance with the recordkeep-
ing requirements of the United States Securities and Exchange Com-
mission would satisfy all requirements imposed by the Texas
Securities Board. The rule contains specific recordkeeping and re-
tention requirements for general dealers and for dealers in municipal
or government securities who do maintain records in compliance with
SEC regulations. Another section of the rule sets recordkeeping
standards for investment advisers licensed in Texas.
