regulations of the EPA and
Corps of Engineers,” added
Bragg.
“They are coming in
through your back door -
directly to your back yard,”
said Day. “All landowners
need to respond to this, not
just the Farm Bureau. This
will affect private property
rights across the country.”
Day added that if the
county signs the resolution,
it will be the first county in
the State of Texas to sign it.
Commissioner Gary Ar-
nold made a motion to ap-
prove and sign the resolu-
tion, seconded by Durwood
Koonsman. It passed unani-
mously and the resolution
was immediately signed by
Judge Word.
In part, the resolution
says, “That Bosque County
strongly opposes the Draft
Guidance in that increases
the need for burdensome
and costly permitting re-
quirements, infringes on
private property rights, and
circumvents the legislative
process, thus, the will of the
people.
“Be it further resolved
that any such change in
jurisdictional power of the
federal government should
only occur as a result of
the passage of federal leg-
islation.”
The resolution notes,
“The Draft Guidance will
infringe upon the sover-
eignty of state(s) to ap-
propriately regulate waters
of the state(s); ... require
counties and special dis-
tricts to obtain costly and
burdensome Section 404
permits from the US ACE
for the construction of
small bridges and culverts;
and routine maintenance
of some ditches, canals,
and other such water con-
veyances;.. . and would in-
fringe on private property
rights, impairing land man-
agement activities such as
urban development and
agricultural production.”
During the regular busi-
ness of the court, it ap-
proved the pay claims,
salaries, and wages
against county funds in
the amount of $81,344.96;
and approved pay claims,
salaries, and wages against
precinct funds.
The county also approved
a resolution for the City of
Clifton relating to the Cul-
tural Alts District.
Sharon Gephart, from
Bosque County Transit
was on hand to speak brief-
ly regarding the new poli-
cies and lowered fees for
Bosque County Transit.
“We are trying to be pro-
active, lowering the fees;
and the HOT region is try-
ing to get all the fares the
same in the region,” said
Gephart.
The court approved the
new policies and fees, as
requested.
The court also approved
United Cooperative Ser-
vices to construct a new
overhead electric distribu-
tion line crossing the right-
of-way on CR 4100, on a
motion by Jimmy Schmidt.
Following a brief expla-
nation by Judge Word and
Dewey Ratliff, the court
approved a decision to re-
scind the land lease with
Smith Bend Water Supply
for the new communica-
tions tower, and approved
a land lease with James
Greenwade to build and
operate a communications
tower near Laguna Park.
“The lease is exactly
the same, this is simply a
preferred location for the
tower,” said Ratliff. “It
will give better coverage
for law enforcement in the
Lake area.”
Greenwade spoke brief-
ly requesting support from
the court for the cost of the
gate and running an access
road to the location. This,
too, was approved.
The court approved con-
verting to the Switched
Long Distance Service for
phone usage after it was
reported that it costs less
than half of what the coun-
ty has been paying for long
distance service.
The annual approval of
property insurance cov-
erage through Texas As-
sociation of Counties was
approved.
Following a brief dis-
cussion on direct deposit
of payroll check, the court
approved that all new hires
will go with direct deposit,
along with those who want
it now.
The investment policy
for the county was ap-
proved; along with the in-
vestment report.
In final action, the court
approved leaving the bum
ban in effect.
