Advertisement and Invitation for Bids
White River Municipal Water District will receive bids for the TWDB Project No. 62587 - Contract No. 4 -
Chlorine Dioxide Generator until 10:00 a.m. on Tuesday, March 29,2016 addressed to Shane Jones, District
Manager at White River Municipal Water District, 2880 FM 2794, Spur, Texas 79370 at which time the bids
will be opened publicly and read aloud.
Bids are invited for work associated with the furnishing and installing a complete and operating Chlorine
Dioxide Generator system at the surface water treatment plant located at White River Lake. The proposed
project includes a one-year maintenance contract and a 6 month supply of 25% Aqueous Sodium Chlorite.
Bid/Contract Documents, including Drawings and Technical Specifications are on file at the office of Elledge
Engineering Corporation., 2020 Lindbergh Drive, PO Box 7110, Tyler, Texas 75711; (903) 780-3251.
Copies of the Bid/Contract Documents may be obtained from the Engineer by payment of $75.00 each set of
documents so obtained. Each such payment will not be refunded.
A Bid Bond in the amount of 5% of the bid issued by an acceptable surety shall be submitted with each bid. A
certified check or bank draft payable to the OWNER or negotiable U. S. Government Bonds (as par value) may
be submitted in lieu of the Bid Bond.
This contract is contingent upon release of funds from the Texas Water Development Board (TWDB).
Any contract or contracts awarded under this Invitation for Bid (IFB) or Request for Qualifications (RFQ) are
expected to be funded in part by financial assistance from the TWDB. Neither the State of Texas nor any of its
departments, agencies, or employees are or will be a party to this IFB, RFQ, or any resulting contract.
This contract is subject to the Enviromnental Protection Agency's (EPA) "fair share policy", which includes
EPA-approved "fair share goals" for Minority Business Enterprise (MBE) and Women Business Enterprise
(WBE) firms in the Construction, Supplies, Equipment, and Services procurement categories. EPA's policy
requires that applicants and prime contractors make a good faith effort to award a fair share of contracts,
subcontracts, and procurements to Minority Business Enterprise and Women-Owned Business Enterprise
firms. Although EPA's policy does not mandate that the fair share goals be achieved, it does require applicants
and prime contractors to demonstrate use of the six affirmative steps. The current fair share goals for the State
of Texas are as follows:

Equal Opportunity in Employment - All qualified Applicants will receive consideration for employment

applicable requirements of 40 CFR Part 33 in the award and administration of contracts awarded under TWDB
financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach,
which may result in the termination of the awarded financial assistance.
All laborers and mechanics working on the work site and employed by contractors and subcontractors on
projects funded directly by or assisted in whole or in part by and through the Clean Water State Revolving
Fund or Drinking Water State Revolving Fund shall by paid wages as described in the section, Mandatory
Davis-Bacon Act Contract Conditions.
The Contractor acknowledges to and for the benefit of the Applicant (“Purchaser”) and the Texas Water
Development Board (TWDB) that it understands the goods and services under this Agreement are being
funded with monies made available by the Clean Water State Revolving Fund and/or Drinking Water State
Revolving Fund that have statutory requirements commonly known as TWDB-0550 Updated 2/10/2015 Page

“American Iron and Steel;” that requires all of the iron and steel products used in the project to be produced in
the United States (“American Iron and Steel Requirement”) including iron and steel products provided by the
Contactor pursuant to this Agreement. The Contractor hereby represents and warrants to and for the benefit of
the Purchaser and the TWDB that (a) the Contractor has reviewed and understands the American Iron and
Steel Requirement, (b) all of the iron and steel products used in the project will be and/or have been produced
in the United States in a manner that complies with the American Iron and Steel Requirement, unless a waiver
of the requirement is approved, and (c) the Contractor will provide any further verified information,
certification or assurance of compliance with this paragraph, or information necessary to support a waiver of
the American Iron and Steel Requirement, as may be requested by the Purchaser or the TWDB.
Notwithstanding any other provision of this Agreement, any failure to comply with this paragraph by the
Contractor shall pennit the Purchaser to enforce this Agreement and recover as damages against die Contractor
any loss, expense, or cost (including without limitation attorney’s fees) incurred by the Purchaser resulting
from any such failure (including without limitation any impairment or loss of funding, whether in whole or in
part, from the TWDB or any damages owed to the TWDB by the Purchaser). While the Contractor has no
direct contractual privity with the TWDB, as a lender to the Purchaser for the funding of its project, the
Purchaser and the Contractor agree that the TWDB is a third-party beneficiary and neither this paragraph (nor
any other provision of this Agreement necessary to give this paragraph force or effect) shall be amended or
waived without the prior written consent of the TWDB. Any contracts in excess of $2,000 for construction,
alteration or repair (including painting and decorating and funded under the Clean Water State Revolving Fund
and Drinking Water State Revolving Fund programs shall include the Mandatory Davis-Bacon Act Contract
Conditions.
White River Municipal Water District reserves the right to reject any or all bids or to waive any informality in
the bidding.
Bids may be held by White River Municipal Water District for a period not to exceed 90 days from the date of
the bid opening for the purpose of reviewing the bids and investigating the bidder’s qualifications prior to the
contract award.
All contractors/subcontractors that are debarred, suspended or otherwise excluded from or ineligible for
participation on federal assistance programs may not undertake any activity in part or in frill under this project.
