The other cl...rye IItiil 1 had acted iiiibecom-
iny an Attorney, at Boston, i shall also notice.
My business detained me at Clarksville till
late on Tuesday evening. By tiding during
aportiuiiut the night I reached Bowie Court
about ten o’clock the next day. Immediately
afterwards 1 got the records of Thurmou vs.
Janes, and suggested to the leading Attorney
on the oppoiite side that I wished to amend,
lly law any party can amend upun motion, as
a matter of right, and the practice of Attor-
neys in this Circuit is to ot.t permission from
the opposite party instead ol too Court, reserv-
ing the right of continuance it necessary, and
subjecting him who amends to cost, if the
Court so order. After having got as I sup-
posed Col. Todd's assent to make amend-
ments, I went with those associated w till ine
in the case, (Jen. Tarrant and Judge Scurry,
and we agreed that a new pica should he
tiled, in order to do which, it was necessary
to strike out one line in one of the old pleas
to avoid inconsistency. This I did in the
presence of the last named gentlemen, sta-
ting to them that I had Col. Todd's assent—
and 1 immediately handed the new plea to
Col. Todd and showed him the alteration.—
lie in open Court objected to the alteration,
and said that he did not assent to it. I in-
stantly in open court re-added the erased
line, and as soon as it was done, by permis-
sion of Court struck 11 mi/, when the Judge
ij-emarked, it was just the amendment lie
-hoi anticipated. If any thing more was said
or -done, I did no hear it. I appeal to the a-
ll:ov; named gentlemen lor the truth ul what
•1 have stated.
l.ot tire statement of Be Morse he com-
pared with the above, and one of us has told a
lie, and let the Attorneys who arc sail! to he
inimical to me, point out the liar I am per-
fectly willing to abide their verdict.
