The Optional County Road Law Of ’47
Section 1 The short title of this Act shall be “The Optional
County Road Law of 1947
Sec 2 Bv a majority vote <>l its qualified voters, any county
in tlu- state at an election held for that purpose, may adopt the
provisions of this Act foi he construction and maintenance of
c. unty roads and bridges and I'm the expenditure of the County
R„ad and Bridge Fund. Such question shall be submitted to the
qualified voters of such county at a general or special election by
I the Commissioners Court of such county, upon petition of a number
| of qualified voters of such county equal to ten (10) per cent of
. the number voting for Governor at the last preceding general elec-
' tion in such c untv, not less than thirty (30) days nor more than
sixty (601 days after the petition is filed with the Commissioners
Court. The ballot for such election shall read:
"For the Optional County Road Law of 1947" or
"Against the Optional County Road Law of 1947.”
If there be a fav< ring vote at uch election, the provisions of this
Act shall become effective with the official proclamation of the
! results ot such electic n In like manner, a county having voted
to come under the provisions of this Act may vote to abandon
the provisions of this Act. but no election on the questions of
adopting or abandoning the provisions of this Act shall be held
oftenor than every two (2) years.
Sec 3 The construction and maintenance of county roads
. t - in the county ro tment which shall include the

Road Engineer as the chief executive officer, other administrative
personnel, and road employes
Sec. 4. The construction and maintenance of county roads,
the ownership and use of all county road department equipment,
materials, and supplies, and the administration of the county road
department shall be on the basis of the county as a whole without
regard to commissioners precincts.
See 5. The County Road Engineer shall be appointed by the
Commissioners Court He shall be a licensed professional engineer,
experienced in road construction and maintenance, who shall meet
the qualifications required bv the State Highway Department for
its county engineers.
Sec. 6. The County Road Engineer shall receive an annual
salary not to exceed Seven Thousand Two Hundred ($7,200.00)
Dollars, the exact amount thereof to be determined by the Com-
missioners Court, and said salary shall be paid in twelve (12) equal
monthly installments out of the Road and Bridge Fund of the county.
See 7 The County Road Engineer shall hold his position for
an indefinitt term and may be removed by a majority vote of the
Commissioners Court. Removal shall not become effective until
thirty (30) days after he hall have been notified in writing of the
intention <0 th< Commissioner- Court to remove him, and until
after a public hearing on the question of his removal shall have been
held, if such hearing is requested of the Commissioners Court in
i writing by the County Road Engineer.
Sec 8 In the absence oi inability of the County Road En-
gined to perilirm hi- dutie the Commissioners Court may desig-
nate a qualified administrative officer to perform the duties of
County Road Engineer during -uch absence or inability.
See. 9. 1 hi County Road Engineer shall be responsible to the
Commissioners Court for the efficient and economical construction
and maintenance ol the county roads. He shall have the power to
appoint for an indefinite term and to remove all county road de-
partment personnel, subject to the approval of the Commissioners
ma> authorize certain administrative personnel to em-
